User Terms

1. Acceptance of Terms

By creating an account or accessing any part of the CarAuction platform ("the Platform"), you agree to be bound by these User Terms ("Terms"). If you do not agree, you must not use the Platform. These Terms form a legally binding agreement between you and CarAuction ("we", "us", "our").

2. Eligibility

You must be at least 18 years of age and legally capable of entering into contracts to use the Platform. By registering, you represent and warrant that all information you provide is accurate, current, and complete.

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at [email protected] if you suspect unauthorised access to your account. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably suspect are engaged in fraudulent activity.

4. Auction Rules

• All bids are legally binding offers to purchase the vehicle at the stated price.
• The minimum bid increment is set per auction and displayed on the listing page.
• Once placed, bids cannot be retracted.
• The highest bid at the close of the auction constitutes a binding sale agreement.
• Auction end times are determined by the server clock. Client-side countdown displays are indicative only.
• We reserve the right to cancel or extend an auction in exceptional circumstances (e.g. technical failure).

5. Buy Now

Listings with a "Buy Now" price allow immediate purchase at that fixed price, bypassing the auction. Exercising Buy Now closes the auction for all other bidders. The purchase is binding and payment is due immediately.

6. Payment

Payment is processed via Stripe. All amounts are displayed inclusive of any applicable fees. Full payment is required within 48 hours of winning an auction or completing a Buy Now purchase. Failure to pay may result in account suspension and forfeiture of your winning status.

7. Vehicle Descriptions

Vehicle descriptions, photos, and condition reports are provided by the seller. We do not independently verify all information. You are encouraged to arrange a physical inspection before bidding. The condition categories (Excellent, Good, Fair, Poor) are indicative only.

8. Prohibited Conduct

You must not:

• Place shill bids or engage in bid manipulation;
• Use automated tools or bots to interact with the Platform;
• Attempt to circumvent security measures;
• Provide false information in your account or bids;
• Use the Platform for any unlawful purpose.

9. Intellectual Property

All content on the Platform, including logos, text, graphics, and software, is owned by or licensed to CarAuction. You may not reproduce, distribute, or create derivative works without our prior written consent.

10. Limitation of Liability

To the fullest extent permitted by law, CarAuction is not liable for any indirect, incidental, or consequential damages arising from your use of the Platform, including loss of profits, loss of data, or vehicle defects discovered after purchase. Our aggregate liability shall not exceed the fees paid by you in the 12 months preceding the claim.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which CarAuction is registered. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in that jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be notified via email or an in-app notice. Continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.
